1. This is an application jointly filed by the parties seeking disposal of the appeal in view of the Settlement Agreement dated 4th September, 2019, arrived at between them. A copy thereof has been enclosed with the present application as Annexure-1.

2. For the reasons stated therein, the application is allowed. FAO(OS) 144/2017

3. All the parties to the settlement agreement are present in the Court today represented by their respective counsel. They confirmed having entered into the Settlement Agreement dated 4th September, 2019. The said agreement is taken FAO(OS) 144/2017 Page 1 of 2

on record. The parties to the agreement are bound by the same.

4. The appeal is disposed of in terms of the settlement arrived at between the parties. The settlement agreement dated 4th September 2019 shall form part of the present order. The parties are directed to take immediate steps pursuant to the settlement arrived at between them. The pending application is also disposed of.
