% 11.07.2017 It is jointly stated by learned counsel that matter has been settled before the Delhi High Court Mediation and Conciliation Centre, New Delhi vide settlement dated 24.05.2017 for a sum of USD 4,28,000 payable in three instalments by respondent company to petitioner.

It is submitted that two instalments have already been cleared by 07.07.2017 and the last instalment is to be cleared on or before 12.09.2017. Both the parties shall be bound by the terms of settlement dated 24.05.2017.

In view of above, nothing survives in the petition. Accordingly, the petition along with miscellaneous application are disposed of having being settled.
