O R D E R

% 07.02.2017 Learned counsel appearing for Ministry of Health, Government of India, states, on instructions, that they have no objection in case Dr. Anirban Hom Choudhuri joins back and reports for duty in the Union of India and other hospitals under the Central Health Services. He submits that the said respondents had earlier issued the Office Order dated 5.10.2016, posting Dr. Anirban Hom Choudhuri at PGIMR and Dr. R.M.L. Hospital. The petitioner had written a letter dated 31.10.2016,

requesting that he should be allowed to continue in GB Pant Hospital for better utilisation of his services towards patients, as he was a specialist in critical care medicines. In view of the request made by the petitioner, the Ministry of Health had issued the Office Order dated 11.1.2017, recalling the earlier Transfer Order.

The petitioner had made a statement on 9.5.2016 that he would like to go back to his parent department, i.e., the Central Health Services. The Govt. of NCT of Delhi has no objection and, as recorded above, the Govt. of India also has no objection. In view of the aforesaid position, we would not like to interfere with the impugned order passed by the Tribunal. The writ petition is accordingly dismissed. CM Nos.15792/2016, 25039/2016 are also dismissed.
