The present application has been filed under Section 151 of the Code of Civil Procedure, 1908 ("CPC"), on behalf of the respondent for release of the decretal amount of Rs. 50,000/- deposited by appellant, in terms of the judgment dated 26th April, 2010, vide cheque bearing no. 402637 dated 21st September, 2010, on 28th September, 2010, and also for the release of the amount of Rs. 94,497/- along with interest, as deposited on 24th June, 2011.

Learned counsel appearing for the respondent submits that the present th appeal was dismissed for non-prosecution, vide order dated 10 July, 2024.

Thus, it is submitted that since the appellant is not interested to pursue the present appeal, the amounts of Rs. 50,000/- and Rs. 94,497/-, respectively, along with interest, be released to the respondent in terms of th April, 2010, passed by the learned Trial Court in the judgments dated 26 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
