% 11.05.2016 Present writ petition has been filed seeking a direction to the respondent to comply with the order dated 1st August, 2014, whereby the Central Information Commission (CIC) had directed the respondent to provide a copy of written submissions dated 12th May, 2014 which had been filed before the Commission on 1st August, 2014.
Learned counsel for the petitioner states that the Commission has failed to ensure compliance of its orders as the petitioner has not been provided with a copy of the written submissions till date. He further states that the respondent has deliberately not provided documents such as Wills of Sh.Nand Lal Rajpal and Mr.Rajendra Rajpal even though the same were furnished to the respondent by Smt.Santosh Rajpal.
This Court has repeatedly held that it is not an executing Court of the CIC. If the petitioner has been deliberately deprived of any
information or documents or the order of the CIC has been violated by the respondent, then it is open to the petitioner to file an appropriate application under the Right to Information Act, 2005. With the aforesaid liberty, the present writ petition and the application are dismissed.
