O R D E R

% 11.02.2016 Both the parties have agreed that Mr.Inder Paul Bansal,Retd Judge, Income Tax Appellate Tribunal who is also in the penal of Delhi International Arbitration Centre ('DAC'), Delhi High Court be appointed as sole Arbitrator to adjudicate the disputes between the parties The arbitration shall take place under the aegis of DAC. The Arbitrator shall ensure the compliance of the provisions of Arbitration and Conciliation (Amendment) Ordinance, 2015 before commencing the arbitration.

The fees of the learned Arbitrator shall be in terms of the Delhi International Arbitration Centre (Administrative Cost Arbitrator's Fees) Rules.

Under these circumstances learned counsel for the petitioner states that the present petition may be treated as application under Section 17 of the Act to be decided by the learned Arbitrator and he would be filing the pleadings of the present case. By order dated 25th October, 2013 the status quo order was passed against the respondent with regard to the title and possession

of the flat bearing No.F-I-907, 9th Floor, Neelpadam Kunj, Vaishali, Ghaziabad, UP. The said interim order shall continue unless it is modified or vacated by the Arbitrator.

With the consent of the parties, the present petition stands disposed of.

Copy of this order be given dasti to the learned counsel for the parties and a copy thereof be delivered to the learned Arbitrator as well as Additional Coordinator, DAC forthwith. MANMOHAN SINGH, J.
