% 27.08.2018 It is submitted that the petitioner's grievance (with respect to the re-assessment notice impugned in these proceedings) has now been rendered infructuous because on the merits in re-assessment, its contentions have been accepted as per its return for Assessment Year 2009-10 by Assessing Officer's order dated 13.06.2018. In these circumstances, the Court is of the opinion that nothing survives in the petition. Accordingly, the petition is dismissed along with pending application.
