O R D E R

% 03.08.2018 The present proceedings under Article 226 of the Constitution of India, essentially seeks a direction to the South Delhi Municipal Corporation (SDMC) to take action, in accordance with law, to close down the branch of the Punjab National Bank operating at F-322-A, Ground Floor, Adarsh House, Lado Sarai, New Delhi (hereinafter referred to as the subject property).

Mr. Ajjay Arora, learned counsel appearing on behalf of SDMC invites my attention to a notice under Section 345-A of the Delhi

Municipal Corporation Act, 1957 dated 30.07.2018 whereby, the Punjab National Bank has been directed to stop the misuse carried on in the subject property within 48 hours from the date of the said notice and file an affidavit in that behalf, failing which, the premises shall be sealed without any further notice.

Mr. Karan Khanna, learned counsel appearing on behalf of Punjab National Bank and Mr. Anand Yadav, learned counsel appearing on behalf of the purported owner of the subject property state that they are aggrieved by the said notice dated 30.07.2018. Needless to state that they are at liberty to assail that notice, in accordance with law, in an appropriate proceeding. Insofar as, the present writ petition is concerned, in view of the said notice dated 30.07.2018, no further orders are required to be passed therein.

The petition stands disposed of accordingly.
