After some arguments, Mr Basu, Senior Advocate appearing for the petitioner has limited his prayers to issuance of directions for implementation to the following points decided by the Travel Agency Commissioner :- "• In light of the above, The Respondent is ordered to assist The Applicant in retaining GDS access and to be able to monitor its bookings.

• The Respondent shall clarify to BSP Participating Airlines, if there is doubt, that they must accept refund requests outside the BSP system."

The learned counsel appearing for the respondent states that there is OMP (I) COMM. 157/2016 Page 1 of 2

no dispute regarding the aforesaid directions. She further states that the respondent does not have control over GDS and the Travel Agency Commissioner's direction is only to the respondent to assist the petitioner to access the GDS to enable it to monitor the booking. She submits that in the event, the petitioner faces any difficulty, the respondent would render such assistance as is reasonably permissible. Further, if there is any doubt, the respondent shall also clarify to its participating airlines that refund request may be accepted outside the BSP System.

In view of the above statement, no further orders need to be passed in this petition. The petition is dismissed.
