% 18.05.2018 The grievances expressed by the petition at hand are wholly frivolous. The copies of the proceedings which have been filed are replete with instances of petitioner himself not being vigilant and diligent in prosecuting the case. So much so reply to the application for amendment which was filed prior to 18.01.2018 was filed two months thereafter on 17.03.2018. Since the application for amendment of the pleadings had come, there was no occasion for the trial court to give primacy to the application under Order XII Rule 6 CPC which may have been filed earlier.
