% 16.05.2018 Notice. Learned APP accepts notice for respondent no. 1. Respondent no. 2 is present in Court and accepts notice. Respondent no. 2 has been identified by ASI Mahavir Singh of Police Station Hauz Khas. Respondent no.2 submits that she has settled the matter with the petitioner of her own free will, voluntarily and without any undue force, pressure or coercion in terms of Compromise / Settlement deed dated 4th May, 2018.
She further states that she has no objection in case FIR No. 1415/2015 under Sections 354/354A/354D/509/323 IPC registered at Police Station Hauz Khas and the consequent proceedings emanating therefrom are quashed against the petitioner.
Affidavit of respondent no.2 is on record at page nos. 15 to 17 wherein also she has accorded her no objection to quashing of FIR against the petitioner.
Keeping in view the settlement arrived at between the petitioner and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
