HON'BLE MR. JUSTICE SANJEEV SACHDEVA

% 09.05.2018 Crl. M.A. 8770/2018 (Exemption) Allowed subject to all just exceptions.
CRL.M.C. 2466/2018 1.
The petitioner seeks quashing of FIR No. 193 of 2015 under Sections 354(C)/354(D)/506 of the IPC Police Station Chandni Mahal, New Delhi, based on a settlement.
2.
It is contended that, the parties have settled their disputes. Settlement agreement dated 02.05.2018 has been executed. 3.
The allegations against the petitioner are that the petitioner has taken photographs of the complainant and thereafter harassed her. The petitioner who is present in Court undertakes that all the photographs which were in CRL.M.C. 2466/2018
his mobile phone have been deleted and he does not possess any copy thereof. He undertakes that he shall not harass the complainant in future. The undertaking is accepted.
4.
Respondent no. 2 is present in person in Court today, represented by her counsel and is identified by the Investigating Officer. She submits that she has settled the disputes with the intervention of locals and respectable people of the locality. Respondent No. 2 submits that she does not wish to press the criminal complaint against the petitioner any further. 5.
In view of the fact that the disputes between the parties has been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom.
6.
In view of the above, the petitions are allowed. FIR No. 193 of 2015 under Sections 354(C)/354(D)/506 of the IPC Police Station Chandni Mahal, New Delhi and the consequent proceedings emanating therefrom are, accordingly quashed, subject to the petitioner depositing cost of Rs.25,000/- to be paid to the Delhi High Court Advocates Welfare Trust within three weeks. The receipt of deposit of the costs imposed by this Order be furnished to the concerned Investigating Officer within a period of four weeks from today.
