BAIL APPLN. 509/2017 This is an application under Section 439 Cr.P.C. filed on behalf of the petitioner seeking grant of interim bail in case FIR No.139/2011, under Sections 364-A/302/394/201/120-B/34 IPC, registered at Police StationI.P.Estate, Delhi. Learned counsel for the petitioner has submitted that the petitioner has to appear in the Sr. Secondary Exams of the Session 2016-2017 under National Institute of Open Schooling . He submits that the petitioner wants to study in stress free atmosphere and it is not possible for him to perform better in the examination without getting bail and prays that the petitioner be
released on interim bail for 25 days.
Learned APP for State has vehemently opposed the bail application and has submitted that the present bail application has been dealt with by the Trial Court vide order dated 08.03.2017. He has further submitted that the impugned order dated 08.03.2017 does not need any interference. I have perused impugned order dated 08.03.2017 passed by learned Special Judge (POCSO ACT)/ASJ-01/Central/THC Delhi. I find no infirmity in the impugned order passed by the Court below. Resultantly, the present bail application is dismissed and disposed of accordingly. Copy of impugned order dated 08.03.2017 be sent to the concerned Jail Superintendent for compliance.
