% 11.05.2018 The present petition has been filed by the petitioner with the following prayers:
"In the premises aforesaid, it is humbly and respectfully prayed that this Hon'ble Court may be pleased to: A.
pass writ of mandamus or order or direction, directing the respondent no.2 to set aside the rejection letter dated 28.12.2017 for rejecting the application for grant of licence of the petitioner in respect of shop vide Pvt. Shop No.2, GF, Prop. NO. L-46, Laxmi Nagar, Delhi - 110092 with the name & style M/s. Calcutta Meat Shop. B.
pass a writ of mandamus or order or direction to the respondent no.2 for granting the license to the petitioner to run the meat trade in the aforesaid shop.

pass any other or further order (s) which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case in the interest of justice."
During the course of hearing, learned counsel for the petitioner submits that against the order dated December 28, 2017 the petitioner has filed an appeal before the Deputy Commissioner, Shahdara South Zone and the same is still pending consideration of the said authority. Mr. Amit Rathore, who appears for the respondents, concede to the aforesaid submission of the learned counsel for the petitioner. He also states, on instructions, the appeal shall be disposed of with eight weeks as an outer limit. The statement is taken on record. In view of the submission, the learned counsel for the petitioner seeks to withdraw the writ petition with liberty to challenge the order to be passed by the Deputy Commissioner, if aggrieved, in accordance with law. The liberty as prayed for is granted. The petition is dismissed as withdrawn.
