% 20.11.2017 EX.APPL.(OS)414/2017 The petitioners have sought the execution of an award dated 12.02.2008. During the pendency of this execution, both the parties have entered into the settlement and have jointly moved the above application along with the settlement agreement, dissolution deed and new partnership firm deed executed between them. The dispute is a family dispute and is now being settled vide agreement / settlement deed dated 30.08.2017 consented to by all the parties to this execution petition. The settlement has been arrived at between them, voluntarily and without any undue pressure, influence or coercion from any corner. The parties have agreed to abide by the terms and conditions of the settlement agreement dated 30.08.2017. In view of above, learned counsel for the decree holder seeks

to withdraw the petition. the parties shall be bound by the terms of settlement agreement.

Consequently, the application is allowed and execution petition stands dismissed as withdrawn having been settled. Parties to bear their own costs.

The date of 06.02.2018 stands cancelled.
