% 11.05.2016 The petitioner is aggrieved by the order dated 20.01.2016 vide which his application under Order 12 Rule 6 of the CPC stood dismissed.

At this stage, learned counsel for the petitioner does not press this petition on merits. He however prays that there should be expeditious in trial as the suit is pending since 2012 and the defence of the defendant had already been struck off way back as on 23.04.2013. Submission being that the defence of the defendant has been struck off, there is hardly be any proceeding left to give a final adjudication. Next date fixed before the Trial Court is in July, 2016. Noting the above factual matrix, the Trial Court shall endeavour to dispose of the suit expeditiously and preferably by the end of this calendar year.

Petition disposed of.
