1. Pursuant to the notice issued in the present petition where the Petitioner has sought directions to the Respondent-State to produce his wife, Neha Gupta, a status report has been filed by Inspector Karan Singh Rana, Station House Officer ('SHO') of Police Station ('PS') Civil Lines, Delhi dated 15th May 2018.
2. In the status report, it is stated that on 13th May 2018, a police team was sent to Agra at the address given of Neha Gupta's parents, i.e. Rajeev Gupta and Radha Gupta (Respondent Nos. 4 and 5). There they found Neha Gupta present. She gave them a written statement that she had left the house of her own accord on 13th March 2018. On the same date, she along with the
Petitioner reached Delhi and got married at a mosque and thereafter left for Jammu & Kashmir. On 24th March 2018, her parents, i.e. Respondent Nos.4 and 5, reached Jammu & Kashmir with the UP Police and then she returned to her parent's house.
3. Neha Gupta is present in Court along with her parents. We first met her in the chamber. She was categorical that she had married the Petitioner of her own will and wishes to reside with him. She is more than 18 years of age. She is interested in sports and is herself a national level fencing player. She met the Petitioner who is an international level fencing player at a fencing event and they got acquainted. Neha informed us that she is interested in pursuing a career in sports, while her parents are not. She stated that she was being threatened by her parents and expressed an apprehension about interference in her marital life by her parents, who are not willing to accept her marriage to the Petitioner. She wanted an assurance from her parents that her married life would not be interfered with by them.
4. We then met Neha's parents, Respondent Nos. 4 and 5 in the chamber. They explained that they could not accept the marriage of their daughter with the Petitioner and wished that she pursues her studies. They however gave an assurance that they would not interfere with her married life. They denied having made any threats to her but assured the Court that they would not extend any threats to her or the Petitioner hereafter.
5. We then met the Petitioner along with his lawyers in the chamber. He explained the circumstances under which he and Neha Gupta had met some years ago and decided to get married. He is a sepoy in the Indian Army and
is currently posted in Bhopal. He expects to be allotted quarters and now that he has married Neha Gupta. He assured that he will look after her well and that she would have no cause for any complaint. His parents have also accepted the marriage and they too would not interfere in the marriage of the Petitioner with Neha Gupta.
6. In the circumstances, the Court directs that Neha Gupta is free to return to the Petitioner from the Court itself. The Court places on record the assurances given to it by the parents of Neha Gupta that they will not interfere in her married life hereafter and would not extend any threats whatsoever to her or the Petitioner.
7. As for any apprehension of threats to their safety that the Petitioner and Neha Gupta may have, the SHO of PS Civil Lines is directed to provide them his mobile number so that they may contact him for such assistance as is required. He will also convey to his counterpart in Bhopal to provide adequate security as required to the Petitioner and his wife.
8. No further directions are called for. The petition is disposed of.
