% 15.02.2018 W.P.(C) 3684/2016 & CM Nos.36366/2016, 37225/2016 Vide the present petition, the petitioner-institute had sought quashing of the letter dated 19.04.2016 issued by respondent No.1 whereby the petitioner No.1-Guru Tegh Bahadur Institute of Technology, Rajouri Garden as well as petitioner No.3-Guru Tegh Bahadur Polytechnic Institute, Vasant Vihar, have been categorised and placed in the 'no admission' category for the academic year 2016-2017.
Learned counsel for the parties submit that during the pendency of the present petition, respondent No.1 has granted recognition to the petitioner No.1 for the academic year 2018-2019 and the parties therefore, submit that the present petition has now become infructuous.
The petition is dismissed as infructuous.
The pending application also stands disposed of. CM Nos.18407/2016 (for intervention) & 40175/2016 (under Section 340 Cr.P.C.) Learned counsel appearing for the applicant in CM No.18407/2016 who has sought intervention in the matter submits that a false statement had been made on behalf of the petitioner before this Court and therefore, he has also filed an application under Section 340 Cr.P.C. being CM No.40175/2016. In view of the fact that the present petition is being dismissed as having become infructuous, learned counsel for the applicant does not press the application, while reserving his right, to initiate appropriate proceedings as permissible under law, on this aspect.
The applications are disposed of as not pressed with the aforesaid liberty.
