The present application has been filed by the appellant stating inter alia that during the pendency of the present appeal, the parties were referred to mediation and in the course of the said mediation, several inter se disputes including the dispute, subject matter of the present appeal that arises from the judgment and order dated 06.04.2018, passed by the learned Single Judge in OMP(COMM) No.258/2017, have been settled. Mr. Nayar and Ms. Dhir, learned counsel appearing for the parties state in unison that the parties have executed a Settlement Agreement dated 06.03.2020 and have already acted on in the terms thereof. 3.

Learned counsel for the appellant seeks leave to withdraw the present appeal, to which Ms. Dhir, learned counsel for the respondent has no objection.

Accordingly, the application is allowed and disposed of. The present appeal is disposed of, as not pressed in terms of the settlement arrived at between the parties. The pending application is also disposed of. 5.

The next date of hearing stands cancelled.
