Learned APP accepts notice for respondent no. 1.

Respondent no. 2 is present in Court along with her counsel and has been identified by SI Jitender of police station Welcome. Respondent no. 2 also accepts notice.

Respondent no. 2 submits that she has settled the matter with petitioner of her own free will, voluntarily and without any undue force, pressure or coercion. Respondent no. 2 further says that her marriage with the petitioner has already been dissolved by a decree of divorce by mutual consent dated 20th January, 2018 passed by the Family Courts, Karkardooma Courts, Delhi. Respondent no. 2 submits that entire settled amount stands received by her and she has no objection in case FIR No.114/2016 under sections 498-A/406/34 IPC and Section 4 of Dowry Prohibition Act registered at police station Welcome, is quashed against the petitioner.

Keeping in mind the facts and circumstances as detailed above, more particularly, the fact that marriage of petitioner and respondent no. 2 has already been dissolved by a decree of divorce by mutual consent, in the interest of justice, the aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
