Learned counsel appearing for the petitioner submits that, the present petition may be disposed of with liberty to the petitioner to make representation before the DDA for the refund of 25% amount deposited by her along with interest, which amount was paid by her for purchasing the property in question in an auction conducted by the DDA.

Evidently, the said amount was forfeited for the failure on the part of the petitioner in depositing the balance amount of 75% within the extended period of 180 days of the auction. 3.

As per the order dated 03.09.2013, the re-auction of the plot in question was not stayed. However, it was ordered that the forfeiture done by the DDA of this subject plot shall be subject to further directions of this Court.

In view of the submissions made by the petitioner, the present petition is disposed of with liberty to the petitioner to submit a representation with the DDA for refund of the amount with accrued interest, if any, which may be considered in accordance with the law. The petitioner be afforded an opportunity of hearing and a decision be taken within a period of eight weeks after the representation is submitted.

This petition is disposed of without prejudice to the rights and contentions of the parties.
