% 22.03.2017 CRL.M.A.4853/2017 Exemption granted, subject to all just exceptions. Application stands disposed of.

W.P. (Crl.) 873/2017 Learned APP for the State accepts notice and points out that one of the complainants namely Jitendar Abrol has not been arrayed as respondent. At this stage, learned counsel for the petitioners submits that she would take necessary steps. The prayer is allowed. Amended memo of parties stands filed on behalf of petitioners. The same be taken on record.

This is a petition under Section 482 Cr.P.C. moved on behalf of the petitioners for quashing of FIR No.1164/2015, under Sections 380/354/451/354(A)/509/427/34 IPC, registered at P.S. Tilak Nagar and all subsequent proceedings arising therefrom.

Learned counsel for the petitioner submits that the petitioners and respondent Nos.2 & 3 are known to each other and there was financial transaction between the parties but due to the misunderstanding arisen between the parties, the respondent Nos.2 & 3 got registered the aforesaid FIR. She further submits that after the registration of the FIR, the near relatives and close friends intervened and the matter has been amicably settled between the parties and the misunderstanding has been sorted out, which has been reduced into writing on 16.03.2017 and nothing further remains to be adjudicated. She further submits that the present FIR is coming as hurdle in the peaceful life of the present petitioners and prays that the FIR in question and all proceedings arising therefrom may be quashed. The respondent Nos.

2 & 3 are present in Court today and has been identified by the Investigating Officer, SI Santosh Kumar. The respondent Nos.2 & 3 admit that the matter has been amicably settled with the petitioners and the misunderstanding has been sorted out and the said settlement arrived at with the petitioner is voluntary and without any force, pressure or coercion and nothing remains to be adjudicated further between them and they have no objection, if the FIR in question is quashed.

meet the ends of justice, I deem it appropriate to quash the aforesaid FIR and all subsequent proceedings arising out of the same. Consequently, FIR No.1164/2015, under Sections 380/354/451/354(A)/509/427/34 IPC, registered at P.S. Tilak Nagar and all subsequent proceedings arising therefrom are hereby quashed.
