In terms of the order dated 06.12.2017 the learned proxy counsel appearing on behalf of Mr.Sanjeet Kumar, Advocate for the appellant submits that the appellant has furnished his undertaking by way of affidavit on 08.12.2017.

It is stated by the appellant in his undertaking that as per the oral settlement arrived at between the parties on 06.12.2017 he shall vacate the suit property No.D-17, New Govindpura, Mandir Wali Gali No.9, Delhi110051 in a peaceful manner and handover the vacant peaceful possession thereof to the respondent on or before 07.10.2018. 3.
Mr.Rajesh Dagar and Mr.Swastik Singh, learned counsel for the respondent on instructions submit that the respondent has no objection if the appeal is disposed of in terms of the undertaking so furnished by the appellant.

In the circumstances, the undertaking by way of affidavit furnished by
the appellant is hereby accepted. The appellant shall vacate the premises in question on or before 07.10.2018 and shall handover the vacant peaceful possession thereof to the respondent on or before 07.10.2018 to the respondent. It is also directed that the appellant shall not create any third party interest.

Appeal is disposed of accordingly.
