Crl.M.C.No.2097/2016 This petition has been filed by the petitioner under Section 440 Cr.P.C. read with Section 482 Cr.P.C. for reduction of surety bond from two sureties to one surety and against the impugned order dated 26.04.2016 passed by the Trial Court.
As per the impugned order, the petitioner was admitted to bail on 07.04.2014. Thereafter accused absented himself on various dates
from 22.07.2015 till 02.02.2016, when he was taken into custody. On 12.02.2016, the petitioner was again admitted to bail on his furnishing personal bond in the sum of Rs.30,000/- with two sureties of the like amount. In this background, the learned Special Judge refused to grant the prayer of the accused seeking reduction in the number of sureties from two to one.
I have heard the learned counsel for the petitioner as well as the learned APP for the State and do not find any ground to interfere with the order of the learned Special Judge dated 26.04.2016. However, on oral prayer made by the learned counsel for the petitioner, the surety amount is reduced from Rs.30,000/- to Rs.25,000/- with two sureties of the like amount.
The petition accordingly stands disposed of.
