+ CRL.M.C. 2831/2018 ARUN SHARMA & ORS ..... Petitioners Through Mr. Madan Lal Sharma, Adv.

versus STATE (GOVT OF NCT DELHI) & ANR ..... Respondents Through Ms. M.S. Oberoi, APP with ASI Ranbir Singh of police station Crime (Women) Cell.

Respondent no. 2 in person

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 23.05.2018 Notice.

Learned APP accepts notice for respondent no. 1.

Respondent no.2 Ms. Archana Sharma is present in Court and accepts notice. Respondent no. 2 has been identified by ASI Ranbir Singh of police station Crime (Women) Cell.

It is submitted that petitioner no.1 (husband) and respondent no. 2 (wife) have started living together after resolving their disputes amicably before the Counselling Cell, Family Courts, North District, Delhi on 10th October, 2017; therefore, FIR No. 37/2012 under Sections 498-A/406/34 IPC registered at Police Station Crime (Women) Cell on the complaint of

respondent no. 2 may be quashed. Respondent no. 2 submits that she has settled the matter with the petitioner no. 1 of her own free will and without any undue force, pressure or coercion and is living with her husband. Respondent no. 2 further submits that she has no objection in case FIR is quashed against the petitioner no.1 and his relatives, that is, petitioner nos. 2 and 3. Affidavit of respondent no. 2 is also on record. Keeping in mind the settlement arrived at between the petitioners and respondent no. 2, more particularly the fact that husband and wife have started living together after resolving their differences, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No. 37/2012 under Sections 498A/406/34 IPC registered at Police Station Crime (Women) Cell and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J.
