The present petition has been filed by the petitioner Riya Batra (Minor) through her mother with the following prayers:- "In view of the above facts and circumstances, it is most respectfully prayed that this Hon‟ble Court may be pleased to: a) Issue a Writ of Certiorari and any other writ of like nature quashing the impugned letter dated 29.03.2016 whereby, the respondent school has advised the parents to withdraw the petitioner from the school in 10th Class as disproportionate punishment is awarded to the petitioner which is in violation of guarantee of fairness under Article 14, 16, 19 & 21 of the Constitution.

b) Issue a Writ of Mandamus directing the respondents to do their public duty of ensuring that the petitioner is allowed to study in 10th Class in respondent no.3 School. c) Pass any other order which this Hon‟ble Court may deem fit and proper to do complete justice to the matter/case." 2.

This Court had passed a detail order on May 16, 2016. Suffice to state, on the assurances given by the mother and the minor petitioner that the minor petitioner shall maintain discipline, the respondent No.3 School was directed to grant readmission to the minor petitioner in Class 10. 3.

On the last date of hearing, it was represented that the minor is maintaining discipline. Today also the learned counsel for the petitioner and the respondent No.3 states, the minor petitioner is maintaining discipline. In view of the statements made and noting the assurances given by the mother of the minor petitioner and the minor petitioner herself and reserving the right of the respondent No.3 to file an application if an urgent issue arises, the petition is disposed of.

CM No. 16165/2016 Dismissed as infructuous.
