Mr Shakil Akhtar, Advocate.

versus UNION OF INDIA AND ORS ..... Respondents Through:

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

% 01.11.2018 1.

The petitioner has filed the present petition, inter alia, impugning the tender notice for licensing of the electronic shops at Vayusenabad, Tuglakabad Air Force Station, Delhi.

It is the petitioner's case that the shops in question had been licensed to the petitioner for a period of one year that had not elapsed and yet the respondents had invited tenders for the same by truncating the petitioner's term. No relief can be granted to the petitioner with respect to the aforesaid prayer as the tender has since, been opened and the period of one year for which the shops were licensed has already elapsed.

2.

The petitioner also impugns a letter for non satisfactory services issued on 14.03.2017. The learned counsel appearing for the respondents states, on instructions, that the said letter was only operative for a period of

one year and is not applicable for subsequent years. Therefore, the said letter is also of no relevance as of date.

3.

The learned counsel appearing for the petitioner seeks to withdraw the present petition in view of the aforesaid statement made by the learned counsel appearing for the respondent.

4.

The petition is dismissed as withdrawn. The pending application is also disposed of.
