O R D E R

% 30.05.2018 The petition at hand seeks to challenge the order dated 09.03.2018 passed by the Additional District Judge on the file of the civil suit (CS No. 9289/2016) - old No. (435/2016) titled Modi Infosol Pvt. Ltd. Vs. Sangee Communication (P) Ltd. whereby local Commissioner has been appointed for recording of the evidence of both parties, the petitioner herein being the defendant, his objection to such arrangement, though noted, having been short-shrifted. After some hearing, the counsel for the petitioner submits that he may be allowed to withdraw the present petition and the applications filed therewith seeking liberty to move the Additional District Judge by a review application setting out the reasons for his opposition to the above-noted arrangement.

The petition and the applications filed therewith are dismissed as withdrawn with liberty as prayed granted.

Needless to add, the Additional District Judge will take into consideration the objections of the petitioner to the recording of the evidence by the local Commissioner, the petitioner herein being primarily opposed thereto for the reason of the cost that it entails. R.K.GAUBA, J.
