% 27.07.2016 IA No. 23696/2015 under section 151 CPC for waiver of cost of Rs. 5000/- imposed vide order dated 07.01.2015 and cost of Rs. 10000/- imposed vide order dated 01.05.2015, moved by plaintiff It appears that inadvertently due to clerical error, the stenographer had wrongly mentioned in the order dated 16.11.2015 that the captioned IA is under section 5 of Limitation Act moved on behalf of defendant no.2 for condonation of delay in filing written statement. Accordingly, the same is hereby corrected. Captioned IA shall be deemed to be on behalf of plaintiff for waiver of costs. CS(OS) 3241/2012 Defendant no.2 has stated that defendant no.1 i.e. his mother has expired on 01.02.2015. He undertakes to file the death certificate on record within one week.
