The present petition was considered on 08.05.2017 and this Court was of the view that an arbitral tribunal ought to be constituted. The arbitral tribunal, as contemplated, under the arbitration clause, consists of three members. At the request of the parties, the appointment of arbitral tribunal was deferred as the learned counsel for the petitioner had requested that instead of a tribunal of three members, a sole arbitrator may be appointed. Mr Jagjit Singh the learned counsel for the respondent had sought time to take instructions in this regard.

Mr Singh now states that the respondent is agreeable for a sole arbitrator to be appointed to adjudicate the dispute which has arisen between the parties in respect of the agreement dated 16.08.2013. 3.

Accordingly, with the consent of the parties, it is directed that the sole

arbitrator be appointed under the Rules of Delhi High Court International Arbitration Centre (DIAC). The parties/ their representatives are directed to appear before the co-ordinator DIAC on 09.06.2017 at 11 AM. The arbitration shall be conducted under the aegis of DIAC and in accordance with its Rules.

The petition is disposed of.
