The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.44/2016 registered under Sections 376/506 IPC and 6 of the POCSO Act at PS Uttam Nagar. Status report is on record. 2.

I have heard the learned counsel for the parties and have examined the file. By an order dated 03.05.2016, the petitioner was granted interim protection and was directed to join the investigation as and when required. At first instance, he was asked to appear before the Investigating Officer on 04.05.2016 at 03.00 p.m. Undisputedly, the petitioner has joined the investigation since then. The Prosecutrix and the petitioner were acquainted with each other since March, 2015. Physical relations took place between the two several times. She BAIL APPLN. 889/2016

allegedly became pregnant also.

The instant FIR was lodged on 13.01.2016. Earlier, the matter was settled / compromised between the parties before October, 2015.

Considering the facts and circumstances of the case, the petitioner is granted anticipatory bail and in the event of arrest, he be released on furnishing personal bond in the sum of ` 40,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. He shall, however, join the investigation as and when required.

The bail application stands disposed of.
