% 02.05.2016 Learned counsel for the petitioner submits that show cause notice dated 4th September, 2014 has been issued by the respondent no.1 under section 345-A read with section 491 of the DMC Act, alleging therein that petitioner is running an industry in a non-confirming/residential area. Petitioner has filed a reply to the said show cause notice dated 16th September, 2014, which is annexed as Annexure-VIII at page 72 of the writ petition. Without passing any order on the representation of the petitioner, respondent no.1 has written to respondent no.3/TATA Power Delhi Distribution Limited to disconnect the electricity supply of the petitioner. With the consent of parties, writ petition is disposed of with the
directions to respondent no.1 to pass a final order pursuant to the show cause notice by taking into consideration the representation of the petitioner and after affording an opportunity of hearing to petitioner. Respondent shall pass a reasoned order and communicate the same to the petitioner. Petitioner shall appear before the Deputy Commissioner, Civil Line Zone, NDMC on 9th May, 2016 at 10:30 am.
Learned counsel for respondent no.3 submits that electricity would not be disconnected till fresh directions are issued by respondent no.1 for disconnection of electricity. Miscellaneous applications are disposed of as infructuous. Dasti.
