O R D E R

% 25.07.2018 By this petition, the petitioner seeks parole on the ground that he and his wife have to undergo IVF treatment.

On a notice being issued status report has been filed. As per the status report the petitioner was earlier granted parole for a period of four weeks on the ground of IVF treatment which was further extended for another four weeks.

As per the nominal roll in this year, petitioner has been granted only one furlough till date for a period of three weeks by DG, Prisons. No other parole and furlough has been granted to the petitioner in this year. Application for parole filed by the petitioner was dismissed by the Competent Authority vide communication dated 28th February, 2018 on the W.P.(CRL) 1476/2018

ground that minimum of six months ought to have elapsed from the date of termination of the previous parole and the petitioner's last parole for a period of eight weeks was upto 26th September, 2018 pursuant to the order of this Court.

As noted above more than six months from the last parole have elapsed. Further only one furlough has been granted to the petitioner in this year. Considering the facts verified and that the learned counsel for the petitioner states that in the furlough awarded to him this year the petitioner has made arrangement for necessary fund and now the treatment of his wife and himself has to be done, this Court deems it fit to grant parole to the petitioner.

It is, therefore, directed that the petitioner be released on parole for a period of four weeks on his furnishing a personal bond in the sum of ₹10,000/- with one surety of the like amount, subject to the satisfaction of the Superintendent, Mandoli Jail. Further the petitioner would provide the mobile phone number available to him and his wife during the period of parole so that in case required he can be contacted. Petition is disposed of.
