% 19.07.2016 This petition has been filed to seek quashing of the FIR No.615/2015 registered at PS Sagarpur under Section 363 IPC. The case of the petitioners is that they out of their own sweet will and desire left their homes and got married. The aforesaid FIR came to be registered at the behest of father of petitioner no.2, who is respondent No.2 in the present petition. On the basis of the school record, he claimed that petitioner no.2 is a minor on the date of the incident i.e. 03.08.2015. However, the parties have now reconciled and the father of petitioner no.2 have accepted the relationship of the petitioner. Accordingly, this petition has been filed, which is supported by respondent No.2, who is present in person and is represented through counsel, who
identifies him.
Respondent No.2 states that the petitioner no.2 was a major at the time of elopement as her correct date of birth is 16.05.1996, and the same was inadvertently got recorded in her school record as 08.10.1998. Learned ASC submits that the police have no objection to the FIR being quashed.
No useful purpose would be served in keeping the FIR and the proceedings arising therefrom pending since the petitioners have got married and have a small child. In the interest of justice, the FIR stands quashed. The petition stands disposed of.
