CM(M) 335/2017 & CM No.11535/2017 I have heard the leaned counsel for the parties. After some argument, the parties for the purpose of disposal of the present petition have agreed as follows:

(i) The documents which are sought to be filed by the petitioner in his list of documents filed along with an application under Order 8 Rule 1(3) CPC i.e. the documents at serial No.2 annexure-A2 and the documents at serial No.4 annexure-A4 shall be permitted to be taken

on record subject to appropriate mode of proof. (ii) The appeal filed by the petitioner against the order dated 12.08.2016 challenging the order of the ARC allowing the application filed by the respondent to place on record the additional documents shall be withdrawn.

With the above directions, the present petition and all the pending applications are disposed of.
