By the present petition the petitioners seek quashing of FIR No.303/2012 under Sections 307/34 IPC registered at PS Kalyan Puri on the complaint of respondent No.2 the injured witness on the ground that the parties have settled the matter.

Learned APP for the State on instructions submits that besides the two petitioners there is no other accused petitioner in the FIR and besides respondent No.2 /complainant there is no other complainant victim in the present FIR.

I have gone through the MLC of the respondent No.2. 4.

The allegations in the FIR are with regard to inflicting injuries to CRL.M.C. 1733/2016

respondent No.2 which due to his defence landed up on his legs and thighs. The injuries have been opined to be simple in nature. 5.

Respondent No.2 who is present in Court and is identified by the learned counsel and the Investigating Officer, still has apprehensions at the hands of the petitioners.

Faced within this situation learned counsel for the petitioners seeks leave to withdraw the present petition.

Leave granted.

8.

Petition is dismissed as withdrawn.
