Mr Mehta, learned counsel appearing for the petitioner seeks to withdraw the present petition with liberty to urge all contentions raised in the petition to assail the final award, if necessary. He further requests that a direction be given to the Arbitrator to hear the parties before taking any decision.

The petition is dismissed as withdrawn with the aforesaid liberty. 4.

Needless to state that it is always open for the parties to approach the Arbitral Tribunal with a request to afford them sufficient opportunity of being heard.
