The petitioner in W.P.(C) No.3390/2016 is the appellant before us. By the order under appeal, the learned Single Judge while grating four weeks time to the respondents/NCTE, adjourned the matter to 15.09.2016. 2.

It is submitted by the learned counsel for the appellant that since the Academic Session 2016-17 is scheduled to commence in July, 2016, unless an interim order is granted directing the respondents to consider the application of the appellant for grant of recognition for D.El.Ed. Course for the Academic Session 2016-17, the appellant stands to suffer irretrievable injury.

Having regard to the fact that the writ petition is still pending, though

we are not inclined to express any opinion on merits of the case, we find force in the submission of the learned counsel for the appellant that the matter needs an early hearing.

In the circumstances, the learned counsel appearing for the respondents/NCTE undertakes to file the counter affidavit on or before 15.05.2016. Advance copy of the same be served on the learned counsel for the appellant/writ petitioner.

Thereafter, the learned counsel for the appellant/writ petitioner is at liberty to make a request before the learned Single Judge to advance the hearing of the writ petition. 5.

The appeal is accordingly disposed of.
