% 10.07.2018 Crl. M.A.9712/2018 (exemption) Allowed, subject to all just exceptions. Application is disposed of. Crl.M.C.2731/2018 Respondent no.2 Ms.Shobhna is present along with her counsel in Court and has been identified by SI Beerpal Singh of PS G.T.B. Enclave. She submits that she has settled the matter with the petitioner no.1 of her own free will and without any undue force, pressure or coercion before the Delhi Mediation Centre, Karkardooma Courts, Delhi on 04.01.2017. Her marriage with petitioner no.1 has already been dissolved by a decree of divorce by mutual consent dated 22.08.2017 by the Principal Judge, Family Court, Shahdara, Karkardooma Courts, Delhi. Petitioner no.1 has paid `1

lac to the respondent no.2 today in Court vide a demand draft, photocopy whereof has been placed on record.

Affidavit of respondent no.2 is also placed on record. Respondent no.2 submits that with this payment she has received entire settled amount and she has no objection in case FIR No. 483/2015 under Sections 498A/406/34 IPC registered at police station G.T.B. Enclave is quashed against the petitioner no.1 and his relatives, that is, petitioner nos. 2 to 4.

Keeping in mind the settlement arrived at between petitioner no.1 and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.
