% 14.05.2018 Learned counsel for the petitioner submits that no allegations of molestation have been levelled in the FIR.
After ten days, statement of prosecutrix/victim was recorded under Section 164 Cr.P.C., wherein she improved her version and stated that petitioner had touched her improperly. I have perused the FIR and the statement under Section 164 Cr.P.C. Learned APP submits that initially FIR was registered under Sections 323/342/34 IPC. After statement under Section 164 Cr.P.C., offences under Sections 354-A/354-B IPC and Section 8 of the POCSO Act and Sections 75/79 of the J.J. Act have been added.
Petitioner has cooperated in the investigation.
Keeping in mind the totality of facts and circumstances of this case, it is ordered that in case of arrest, petitioner be released on bail, subject to his furnishing a personal bond in the sum of `10,000/-(Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned. Bail application is disposed of in the above terms. Dasti.
