% 04.01.2016 I.A. No.15322/2015 (u/o VIII R 1 CPC by defendants) The above mentioned application has been filed by the defendants under Order VIII Rule 1 CPC praying that the written statement filed by the defendants be taken on record. Learned counsel for the plaintiff states that the plaintiff has no objection if the prayer is allowed, subject to cost.

Accordingly in view of the statement made in the application, the prayer is allowed. The written statement is taken on record, subject to cost of Rs.10,000/- which shall be paid by the defendants to the plaintiff within four weeks from today.

The application is disposed of.

CS(OS) 2593/2012 Replication which is already filed is taken on record. The valuation of the suit is Rs.1,11,00,000/-. In view of Section 4 of the Delhi High Court (Amendment) Act, 2015 and the order passed on 24th November, 2015, the suit is transferred to the jurisdiction of District Judge (HQ) (Central), Tis Hazari Courts, Delhi.

Parties to appear before the concerned Court on 8th March, 2016. MANMOHAN SINGH, J.
