% 04.08.2016 By the present petition the petitioner seeks anticipatory bail in case FIR No.32/2016 under Section 498-A/377/406/506/34 IPC registered at PS Kirti Nagar.
The petitioner is the husband of the complainant. The allegations in the FIR against the petitioner are that at the time of marriage the parents of the complainant spent a huge amount of `15 lakhs of which `5 lakhs was given as cash, however on the next day she was taunted that she had not brought swift car and was beaten. She further alleged that on the same day her husband in a drunken condition committed unnatural sex with her. BAIL APPLN. 947/2016
The petitioner has placed on record documents to show that the parties have settled the matter and the settlement was endorsed by the mother and the other family members of the complainant. However, the complainant who is present in Court states that the settlement was arrived at contrary to her wishes.
Be that as it may, the petitioner has returned the istridhan articles as per the admitted list. He has already joined the investigation. Thus, considering the facts and circumstances of the case I deem it fit to grant anticipatory bail to the petitioner. It is therefore directed that in the event of arrest, the petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with one surety of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that he will join the investigation as an when directed by the investigating officer and will not leave the country without the prior permission of the Court concerned.
Petition is disposed of. Order dasti.
