% 05.07.2017 The facts disclose that the petitioner had supplied the lubricant oil and the amount of Rs. 10,66,604.47 is outstanding against the respondent. Various requests were made to the respondent but the respondent company did not make the payment. On 25.03.2014 the statutory notice was issued and thereafter this petition was filed. Today the matter stands settled between the parties and the respondent company has agreed to pay an amount of Rs.12 lakhs in full and final settlement to all claims of the petitioner and has in fact handed over to the petitioner two cheques bearing No.001711 dated 12.05.2017 of Rs.9,14,395/- and No.001753 dated 04.07.2017 of Rs.1,52,209/- drawn on HDFC Bank and undertake to encash the same and further to pay the balance within a week from today. The said undertaking is accepted. In view of the undertaking so made, the learned counsel for the petitioner now intends to withdraw the petition.

The petition is dismissed as withdrawn.
