This petition by way of Public Interest Litigation has been filed seeking a direction to the respondent Nos.1 to 3 to take action for demolition and sealing of the unauthorized construction over the land belonging to DDA situated adjacent to Krishna Mandir, backside of LIG DDA flats in Phase-I, Village-Katwaria Sarai, New Delhi being carried on by the builder by name, Mr.Vikas Goyal.

At the outset, it is represented by learned counsels appearing for the SDMC and DDA/respondent Nos.1 to 3 that the very same issue is the subject matter of W.P.(C) No.2499/2016 pending before a Single Bench of this Court. The counsel for the petitioner has not disputed the same. 3.

Since this Court is seized of the very same issue, it is not necessary to entertain the present petition filed as PIL.

Accordingly, the writ petition is dismissed.
