CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 29.05.2018 Learned counsel for respondent no.2 submits that he has received instructions from respondent no.2 that matter has been settled with the petitioners, in as much as, settled amount has been received and 'No Due Certificate' has also been issued. Learned counsel for respondent no.2 further submits that respondent no.2 has no objection in case FIR No.1401/2014 under section 379 IPC and 135 of Indian Electricity Act and the consequent proceedings emanating therefrom, are quashed.

Keeping in mind the totality of facts and circumstances, as detailed hereinabove, I am of the view that in light of settlement arrived at between petitioners and respondent no.2 voluntarily, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, the aforesaid FIR and consequent proceedings

emanating therefrom, are quashed.

Petition is disposed of as withdrawn.

Miscellaneous applications are disposed of as infructuous. A.K. PATHAK, J MAY 29, 2018 sm
