Present writ petition under Article 226 of the Constitution of India read with Section 482 Cr.P.C. has been preferred by the petitioners for transfer of complaint case bearing No.S-124 registered with CAW Cell, Rani Bagh to Police Station Keshav Puram and for its clubbing with FIR bearing No.111/2018, Police Station Keshav Puram. Status report not filed.

I have heard the learned counsel for the parties and have examined the file.

On the complaint of respondent No.4 FIR No.111/2018 under Sections 420/468/406/471/34 IPC has been W.P.(CRL) 1493/2018

registered at Police Station Keshav Puram. Respondents No.4 has also filed a complaint before CAW Cell, Rani Bagh, which is under consideration.

Both the FIR No.111/2018 and the complaint case No. S-124 registered at CAW Cell are at its initial stage and are under investigation. Respondent No.4 cannot be prevented to have recourse to legal proceedings before CAW Cell. At this stage, no directions can be given to CAW Cell to transfer the said complaint to Police Station Keshav Puram. It is premature to order both the said cases (FIR No.111/2018 and the complaint case No. S-124 registered at CAW Cell) to be clubbed together.

The writ petition being unmerited is dismissed. 6.
