% 14.01.2016 Mr. Anil K. Khaware, learned counsel appearing for the plaintiff states that in view of the fact that an Arbitrator has been appointed to adjudicate the inter-se disputes between the parties in Arbitration Petition No.154/2015, he wishes to withdraw the present suit. In view of the statement made by the counsel for the plaintiff, the suit is dismissed as withdrawn.

At this stage, Mr. Khaware states that the plaintiff is entitled to the refund of Court Fees. In terms of Section 16 of the Court Fees Act, 1870 read with Section 89 CPC, the Registry will issue a certificate authorising the plaintiff to receive back from the Collector, the full amount of the Court Fees paid on the plaint.
