% 26.07.2018 By this petition the petitioner seeks parole on the ground that he has to search a suitable match for his sister and to arrange funds for the marriage ceremonies.
On a notice being issued, a Status Report has been filed. As per the Status Report, the family of the petitioner is residing at Ward No.10, Mohalla Pipleepura, Village, Post, Tahsil - Barod, District Agar Malwa, Madhya Pradesh. Petitioner's sister who is aged 24 years, is unmarried. As per the Status Report, the petitioner was involved in two other cases one for offences punishable under Section 354/506 IPC and under Section 25(B-1) B of the Arms Act wherein he has been acquitted. In the present case also, the petitioner pleaded guilty and was thus awarded sentence of W.P.(CRL) 1561/2018
imprisonment for five years out of which he has undergone nearly three years 8 months' sentence with remissions and only one year and 4 months' period of sentence is remaining.
Considering the verification report and the conduct of the petitioner this Court deems it fit to grant parole to the petitioner. It is, therefore, directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court/CMM further subject to the condition that the surety would be a family member of the petitioner. Petition is disposed of.
A copy of this order be communicated to the petitioner through Superintendent, Tihar Jail.
