% 02.06.2016 (1) The petitioner seeks anticipatory bail under Section 438 read with Section 482 Cr.P.C. in case FIR No.441/14 under Sections 308 IPC registered at Police Station Seema Puri.
Status report is on record.
(2) I have heard the learned counsel for the parties and have examined the file. FIR pertains to the year 2014. Charge-sheet has not yet been filed. Order dated 25.06.2014 (Annexure P-6) reveals that the complainant had appeared before the Trial Court and had disclosed to have sustained injuries due to fall from the bus and not by assault by the complainant. MLC (Annexure P-7) discloses that BAIL APPLN. 921/2016
nature of injuries could not be ascertained as the patient absconded from the hospital. Order dated 19.04.2016 reveals that the Trial Court was not satisfied with the investigation carried out in the case. DCP (N/E) was directed to conduct inquiry into the omissions on the part of previous Investigating Officers.
(3) Considering the facts and circumstances of the case, the petitioner is admitted to anticipatory bail and in the event of his arrest, he be released on bail on his furnishing personal bond in the sum of `40,000/-with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with the condition that he shall join the investigation as and when required.
(4) The bail application and Crl.M.B.No.941/2016 stand disposed of.
