% 25.05.2018 Vide the present petition, the petitioner, has sought a direction to the respondent no.1 to decide its statutory appeal dated 03.02.2018 in an expeditious manner. The petitioner has also sought a direction to stay the operation and effect of the withdrawal order dated 08.01.2018 issued by the respondent no.2.
On the last date, Ms.Arunima Dwivedi, learned counsel who appears for the respondents had sought time to get instructions. Today, Mr.Karan Sharma, learned counsel for the respondents on instructions, states that the petitioner's appeal will be taken up for hearing tomorrow i.e. on 26.05.2018 itself.
At this stage, learned counsel for the petitioner submits that in view of the fact that, the impugned withdrawal order is causing grave prejudice to the petitioner, the respondent no.1 may be directed to decide the petitioner's appeal in an expeditious manner.
Learned counsel for the respondents prays for atleast 30 days to decide the petitioner's appeal.
However, keeping in view the fact that the impugned withdrawal order is causing grave prejudice to the petitioner which is a running institute for the last many years, the respondent no.1 is directed to decide the petitioner's appeal on or before 31.05.2018 by passing a reasoned and speaking order.
Needless to say, in case, the petitioner is aggrieved by the order passed by the respondent no.1, it will be open for the petitioner to take legal recourse as permissible under law. The writ petition alongwith pending applications are disposed of in the above terms.
